GENERAL CONTRACTING CONDITIONS

  1. SCOPE These General Conditions regulate the Contract between you, as USER, and the Flashh Boulderspot SL Climbing Room located at C/ Vic, 4-12 08173 de Sant Cugat del Vallès (CIF B01986926), hereinafter The Room. To these General Conditions, you will have to add the Particular Conditions according to the contracted service or activity, as well as the Rules of Use, these three documents being the ones that completely regulate the relationship between you, as USER, and La Sala. Failure to comply with this contract will result in automatic expulsion from the facilities for reasons of security or inappropriate behavior.

  2. CONDUCT

    1. The USER acknowledges and understands that block climbing and overcoming obstacles designed for that purpose in the Flux area are sporting activities not exempt from the risk of injury. The Chamber undertakes to take the necessary actions to ensure that the risks assumed by climbers are the usual or legally admissible under normal or foreseeable conditions of use of a block climbing facility, adopting all the necessary security measures so that these are not increased.

    2. The USER expressly accepts that the contracted service, under normal and foreseeable conditions of provision, carries a risk qualified as acceptable and unavoidable by the type of contracted activity, which he consents to.

    3. The USER declares that he knows and has been given and explained the rules of use and safety warnings of La Sala. Accept these rules and understand what behaviors are not allowed for security reasons.

    4. The USER declares that he meets the physical and mental conditions necessary to use La Sala's facilities.

    5. The USER undertakes not to use the facilities under the influence of alcohol, drugs or any other medication that may affect their ability to react. If the staff of La Sala detects any anomaly that implies a decrease in the USER's capabilities, La Sala may expel said USER from the facilities.

  3. OPENING HOURS AND ACCESS RESTRICTIONS The Room is open from Monday to Friday from 09:00 to 23:00 and Saturday and Sunday from 10:00 to 20:00. Hours may vary. This information will be published in advance on the information panel located in the reception of the center, on social networks and communicated via e-mail. In case of total closure or limited access, the proportional part of the monthly subscriptions or scheduled activities will not be reimbursed, unless such decision is due to force majeure. If the closing or limitation responds to a business decision of La Sala, it must reimburse the USERS for the proportional part of the season ticket acquired, and not enjoyed. The Hall reserves the right to temporarily limit access to certain areas of the facility for reasons of activities, competition, events, cleaning, maintenance, equipment, or any special event. These limitations will be communicated to the USER in advance. If the limitation of access and use will affect more than 50% of THE ROOM for 7 days or more, said alteration of the service must be compensated by discounting the proportional part in the following subscription or, in the event that there is none, making a subscription to the USER.

  4. ACCESS To access the facilities of La Sala in order to perform physical activity or attend events (participants or spectators) it is mandatory to hire the corresponding service or to register at reception in the case of events. The Hall will be able to issue membership cards or special digital codes for its registered users. This card will identify the authorized holder, the subscription category and the customer number.

  5. FEES AND PAYMENTS To consult the conditions of contracting, payment and characteristics associated with each service, you must go to the particular Conditions of each one of them. In any case, the offer and prices of services will be permanently displayed on the reception panels.

  6. RULES FOR MINORS. Minors may only access the facilities of La Sala: - Accompanied by one of their parents or guardians - Prior express consent of their parents or guardians formalized by signing the Authorization document for the practice of sports activity by minors in the facilities of La Sala. The Hall reserves the right to refuse entry to minors or to exclude minors from an activity for reasons of security or inappropriate behavior. The specific conditions in relation to each service or activity are included in the particular conditions of the same.

  7. DISCOUNTS - SPECIAL CONDITIONS The room offers different types of discount: - Discount by opening hours, entry before 15:00 on working days - Family, members' children - Special discounts: under 18, students, unemployed and over 65 - Parents with children enrolled in extracurricular activities.

  8. EQUIPMENT RENTAL To rent equipment, a valid identity document must be submitted along with the amount of the requested rental. The USER undertakes to make correct use of the rented material and La Sala to maintain said material in optimal conditions of use.

  9. DATA PROTECTION

    1. Your personal data will be stored in an automated database that is the property and responsibility of La Sala. Your personal data are necessary to process your registration as a member, make the necessary communications between you and La Sala, maintain security and control access to the club, as well as contribute to the security of the club through the video surveillance system. Your treatment is legitimate to the extent necessary to facilitate our respective fulfillment of this contract. The data will not be transferred to third parties except in cases where there is a legal obligation. The above means that, if you do not provide the requested personal data, it will not be possible to fulfill the conditions of the contract.

    2. As a member, you can exercise your rights of access, rectification, suppression, cancellation, limitation of treatment, objection and portability of your data in accordance with the conditions stipulated in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016 (the General Data Protection Regulation) by contacting us at [email protected] , in which case you must prove your identity. Your personal data may be kept during the entire period of the contract and after this, during the periods of conservation necessary to guarantee our compliance with the applicable legislation.

    3. You can contact La Sala's data protection officer by writing an email to [email protected] .

    4. If you have given your consent to the processing of your personal data, you can withdraw it at any time by writing to the address indicated above or to the email address [email protected] (in both cases, you must send a photocopy of your national identity document or equivalent document so that we can confirm your identity). The revocation will not affect the legitimate nature of the data processing carried out until then.

    5. If you consider that the processing of your data does not comply with the applicable data protection legislation, you have the right to file a complaint with the Spanish Data Protection Agency or another relevant supervisory authority.

    6. Commercial videos and photographs not authorized by La Sala are prohibited. Photographs and videos can only be taken for personal use. Recording videos and taking photographs in the changing rooms is prohibited

  10. PHOTOGRAPHS The USER authorizes La Sala to take photographs of the activity, divulge them and make commercial use of them, committing La Sala to use said images solely to divulge its activity, which may be published in:
    - The website www.flashh.es
    - La Sala social networks
    - Photographs for local, regional, provincial, autonomous or national newspapers, magazines, billboards or advertising brochures

  11. SECURITY

    1. The Chamber undertakes to guarantee the security of its facilities, carrying out the necessary preventive actions and periodic inspections. In case of detecting any defect or danger that could increase the risk of the activity or the consequences of the damage for the USER, La Sala will adopt the appropriate corrective measures.

    2. USERS are required to immediately report to La Sala staff any deterioration or security problem detected to ensure that the facilities maintain optimal security conditions at all times and minimize the likelihood of an accident and/or its consequences.

  12. BELONGINGS The Hall is not responsible for objects that may be lost in any of the facilities, including the parking areas, nor, in particular, for objects that are deposited in the ticket offices.

  13. CLAIMS SHEETS Complaints sheets are available to USERS.

  14. RIGHT OF WITHDRAWAL According to the provisions of art. 211-15 Law 22/2010, of July 20, of the Consumer Code of Catalonia and in the arts. 68-79 of Royal Legislative Decree 1/2007, of November 16, by which the revised text of the General Law for the Protection of Consumers and Users and other complementary laws is approved, the USER may exercise his right of withdrawal under the conditions established in the aforementioned regulations
